Consultation Systems Approaches to Free, Prior, and Informed Consent: Intent and Practices in British Columbia, Alberta, and Saskatchewan

Canada has a legal duty to consult with Indigenous Nations impacted by resource development to gain free, prior, and informed consent (FPIC). Natural resource development under provincial jurisdiction means provincial governments are required to engage in consultation.
The implementation of provincial consultation systems can demonstrate the government’s ability and desire to move towards reconciliation and further decolonization as suggested in the Truth and Reconciliation Commissions (TRC) Calls to Action.
We investigated how British Columbia (BC), Alberta (AB), and Saskatchewan (SK) describe the “intent” (e.g., guiding principles, goals) and “practice” (e.g., depth, timeframes) of consultation their public guidelines.
The intent of consultation was described differently across the provinces. For example, BC highlighted mutual understanding, while AB emphasized the soliciting of concerns and minimizing impacts. The practice of consultation varied between provinces, but all hold a key theme of provincial governments defining when consultation is triggered, its level categorization, who is consulted, and consultation timelines. For instance, AB favoured industrial proponents with traditional economic landscape values and short timeframes that disregard Indigenous landscape values and governance systems.
Some provincial consultation systems seem to be slower adopting practices that decolonize government structures; provincial governments hold the decision-making power while reinforcing colonial relationships with the land, space, and place. Ultimately, we conclude the consultation systems of BC, AB, and SK move toward meeting the TRC’s Calls to Action but these moves fall short in their implementation of FPIC, reconciliation, and Indigenous self-governance.
