Essential Work in Policy: Understanding National and Provincial Legislation’s Effect on Canadian Grocery Store Workers throughout COVID-19

Government policy has the capacity to be a transformative force to improve labour conditions and industry practices. Current events, such as the COVID-19 pandemic, rise in job insecurity, cost of living crisis, and grocery competition investigation, have prompted provincial and national governments in Canada to attempt to address the challenges faced by workers with legislation. Specifically, this study examined Canadian and Ontario legislation which provides labour protections for grocery workers and regulates the grocery industry. The goal of this investigation was to understand the implementation process for changes to labour legislation that affected these businesses. It also evaluated how these changes reflect prevailing discourses about the precarity of grocery workers. Legislation was identified using the e-Laws and the Justice Laws websites; then, CanLII was used to explore version changes to each piece of legislation from March 2019 through April 2024. Sections of legislation were extracted and thematically coded based on their relevance to employment in grocery stores, essential work during COVID-19, and labour protections against precarious employment. Detailed information for the implementation process for applicable pieces of legislation were obtained from the national parliament website, LEGISinfo, and the legislative assembly of Ontario websites. This information was used to construct an implementation timeline for key policies that affected the grocery workplace from March 2019 through April 2024. These results provide insight into the labour policymaking process in Canada to better understand where advocates for labour equity can influence decisions to ameliorate labour conditions for grocery and other low-wage workers.
